Hazardous Waste Onsite Treatment: Tiered Permitting Program

The Hazardous Waste Treatment Permitting Reform Act of 1992 allowed facilities to treat some types of hazardous waste on-site through the Tiered Permitting Program. There are 4 tiers for on-site treatment permitting:

  1. Conditionally Exempt Small Quantity Treatment (CESQT)
  2. Conditionally Exempt - Specified Waste stream (CESW)
  3. Conditionally Authorized (CA)
  4. Permit By Rule (PBR)

Each facility covered by the on-site treatment permitting program must submit a facility specific notification and a unit specific notification for the appropriate tier for each treatment unit the facility operates before operations may commence. In addition, such facilities must complete and submit the applicable CUPA registration forms depending on the waste and type of treatment. In Monterey County, the Monterey County Environmental Health Division, which is the local CUPA (Certified Unified Program Agency) administers the Tiered Permitting Program.
