Phase II Municipal Permit

What is the Phase II Municipal permit?

- Created by Clean Water Act regulations under the National Pollutant Discharge Elimination System(NPDES) program for storm water discharges

- Applies to small municipalities with populations <100,000

- A general permit that applies statewide in order to minimize pollution discharging from storm drain systems or Municipal Separate Storm Sewer Systems (MS4s)

- Applies only to urbanized areas of the County determined by the US Census Bureau (Figure 1)

- Became effective July 1, 2013

- New and increased Permit requirements for municipalities will be phased in over the five-year permit cycle

 

 Who does the Phase II Permit apply to?

- The Urbanized Areas of Monterey County are regulated under the Phase II Municipal Permit. 

Construction projects located within the Urbanized Area (see Figure 1 below) may have additional requirements to retain or treat stormwater before it leaves the site. 

Additional requirements are dependent upon the size and complexity of the project, its location within the Urbanized Area, and where runoff from the project will flow.
